1. Introduction
These Terms of Service ("Terms") govern your use of the website thedoorkr.com and the services provided by The Door ("we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms.
The Door is a concierge and facilitation service that connects international patients with partner dermatology and aesthetic clinics in South Korea. Please read these Terms carefully, as they contain important information about your rights and obligations.
2. Nature of Our Services
The Door is a medical tourism concierge service. We provide the following:
- Facilitation of remote consultations between you and doctors at our partner clinics, including collection and secure transmission of photos and treatment preferences.
- Communication of doctor assessments, including recommended procedures, estimated costs, and recovery information.
- Coordination assistance between you and our partner clinics.
- Translation and communication support.
The Door is NOT a medical provider, hospital, clinic, or healthcare facility. We do not provide medical advice, diagnoses, or treatment. All medical services, including consultations, assessments, procedures, and aftercare, are provided by our partner clinics and their licensed medical professionals.
3. Medical Disclaimer and Limitation of Liability
THIS IS AN IMPORTANT SECTION. PLEASE READ IT CAREFULLY.
All medical procedures, whether surgical or non-surgical, carry inherent risks including but not limited to infection, scarring, asymmetry, nerve damage, allergic reactions, dissatisfaction with results, and other complications. These risks exist regardless of the skill of the doctor or the quality of the clinic.
The Door does not perform any medical procedures. All medical treatments are performed by licensed medical professionals at our partner clinics. The medical relationship is between you and the treating clinic and doctor.
The Door is not responsible or liable for:
- The outcome or results of any medical procedure performed at a partner clinic.
- Any complications, side effects, adverse reactions, or medical emergencies arising from medical procedures.
- The medical judgment, advice, or decisions made by doctors at partner clinics.
- Any dissatisfaction with aesthetic results or the need for revision procedures.
- Post-treatment complications that may arise from patient non-compliance with aftercare instructions, including but not limited to failure to follow medication protocols, consuming alcohol, smoking, or engaging in activities against medical advice.
By using our services and proceeding with any medical procedure through our partner clinics, you acknowledge and accept these inherent medical risks and agree that The Door's role is limited to facilitation and coordination.
Any disputes regarding medical outcomes, procedure quality, or clinical care are between you and the treating clinic. The Door will make reasonable efforts to assist with communication between you and the clinic but assumes no liability for the resolution of such disputes.
4. Consultation Process
When you submit a consultation through our platform:
- You agree to provide accurate and truthful information about your medical history, current conditions, and treatment goals.
- You understand that remote assessments based on photos and descriptions are preliminary in nature. Final treatment plans, pricing, and recommendations may change after an in-person evaluation by the doctor.
- You understand that estimated costs provided through our platform are approximate and may vary based on the doctor's in-person assessment of your condition.
- You understand that photos you submit will be shared with the consulting doctor at our partner clinic for the purpose of providing an assessment.
5. Partner Clinics
Our partner clinics are independently owned and operated medical facilities. While we vet our partners for professional credentials, clinical standards, and patient care quality, each clinic operates under its own medical license and is independently responsible for the medical services it provides.
The Door does not control, direct, or supervise the medical decisions or procedures performed by partner clinics. Our partnership with a clinic is not a guarantee of any specific medical outcome.
6. Your Responsibilities
By using our services, you agree to:
- Provide accurate personal and medical information.
- Disclose all relevant medical conditions, allergies, medications, and previous procedures that may affect your treatment.
- Follow all pre-procedure and post-procedure instructions provided by your treating doctor.
- Make your own informed decisions about whether to proceed with any medical procedure, after consulting with the treating doctor.
- Obtain appropriate travel insurance for your trip to South Korea.
- Comply with all applicable laws and regulations in your country of residence and in South Korea.
7. Fees and Payments
The Door may charge service fees for concierge and coordination services. These fees are separate from medical procedure costs, which are paid directly to the clinic.
Service fees, when applicable, will be clearly communicated before you are obligated to pay. Medical procedure costs are determined by the partner clinic and are subject to change based on in-person evaluation. The Door is not responsible for price changes between the initial estimate and the final clinic quote.
8. Cancellation
If you wish to cancel a consultation or planned procedure, please contact us as soon as possible at concierge@thedoorkr.com.
Cancellation terms for medical procedures are determined by the individual partner clinic's policies, not by The Door.
9. Intellectual Property
All content on our website, including text, images, logos, and design elements, is the property of The Door and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.
10. Limitation of Liability
To the maximum extent permitted by applicable law, The Door, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to damages related to medical procedures, travel arrangements, or any other services facilitated through our platform.
Our total liability for any claim arising from our services shall not exceed the amount of service fees you have paid to The Door in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless The Door, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or any dispute between you and a partner clinic regarding medical treatment.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
13. Dispute Resolution
Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in English.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our website. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
